DOCUMENTS FOR NATIONAL APPLICATION

1. Filing A Patent Application For Invention in China (P.R.C)

    1. Specification (description + claims + abstract + drawings);
    2. An order letter, indicating the title of invention, the name and address of the applicant/inventor in Chinese and foreign language (as the foreign client), the priority date and basic application number (if the priority is claimed);
    3. A Power of Attorney executed by the Applicant (may be late submitted within 2 months after the Chinese Filing Date). Please refer to the enclosure for our Power of Attorney.
    4. The certified priority document and form of assignment (If the Applicant of basic application indicated in the certified priority document is bot the same as the one in the Chinese application) which may be late submitted within 3 months from the Chinese Filing Date.

Please note that the priority period of a patent application for invention is 12 months. And of the 12 months period is over, the application can still be filed as a non-convention application before the application first filed in another country being published.

2. Filing A Patent Application For Utility Model in China (P.R.C)
Ditto as the above, but please note that method can't be claimed; a utility model application must include drawings.

3.Filing A Patent Application For Design in China (P.R.C)

    1. An order letter, indicating the title of the design, the name & address of the applicant/designer in Chinese and foreign language (as the foreign client), the priority date and basic application number (if the priority is claimed).
    2. A Power of Attorney executed by the Applicant (may be late submitted with in 2 months from the Chinese filing Date). Please refer to the enclosure.
    3. The certified priority document and form of assignment (if the applicant of basic application indicated in the certified priority document is not the same as the one in the Chinese application) may be late submitted within 3 months after Chinese Filing Date. Please note that the priority period for a design patent application is 6 months.
    4. One set of drawings (front, rear, top, bottom, right and left views), plus a perspective view. The size of the drawing s should be:

3cm X 8cm < size < 15cm X 22cm

Instead of drawings, photos can be provided:

    1. Two sets of black and white photos (six two-dimensional views, as described above plus a perspective view) if no color is to be protected; or two sets of color photos and one set of black & white photos if the color is to be protected.
